Terms of use.

Acceptance

These terms are a contract between you and MAD Solutions Ltda, CNPJ 51.888.856/0001-86 ("we"), owner of MadBuilder. By creating an account or using the platform, you agree to them and to the privacy policy. If you use MadBuilder on behalf of a company, you represent that you can accept these terms for it.

The service

MadBuilder is a platform for creating web systems that generates Laravel projects. It includes the Manager, the visual editor, data modeling, the AI agent, the Online Test and, as an option, hosting on MadCloud. What each plan includes is on the pricing page.

MadBuilder is in open beta. This means features may change, be added or removed, and instabilities may happen. We will notify you of relevant changes.

Your account

• Provide accurate information and keep your email up to date. It is how we reach you.
• You are responsible for what happens in your account. Keep your password safe and turn on two-step verification (2FA).
• Each license is for one developer. Do not share the same login between people: for more people, buy additional developers.
• If you notice misuse of your account, let us know at contato@madbuilder.com.br.

Plans and payment

• The Free plan costs nothing and has the limits described on the pricing page.
• The Starter, Advanced, Pro and Pro AI plans are billed per developer, per year. Each additional developer costs the price shown on the plan.
• The Mad Coding Plan is a monthly subscription with coding AI included. It works from the Pro plan up and has a weekly quota and a limit every 5 hours, as described on the pricing page.
• Payment is processed by Mercado Pago. We issue an invoice with the data you provide.
• You can upgrade to a larger plan at any time. Prices may change for new purchases, but what you have already paid is valid for the contracted period.

Right of withdrawal and cancellation

Because the purchase is made over the internet, you can withdraw within 7 days of purchase and get a full refund, as guaranteed by article 49 of Brazil's Consumer Protection Code.

The code and the data are yours

The code MadBuilder generates for your project (models, migrations, controllers and views) is yours. On the plans that allow it, you download the project as a ZIP, push it to your Git or deploy it to your server. The project includes the MAD framework, which provides the components used in the screens.

The data you put on the platform, and your customers' data, is also yours. We process it only to provide the service, as explained in the privacy policy.

The platform is ours

MadBuilder itself (the editor, the agent, the Manager, MadCloud, the brand and the documentation) belongs to MAD Solutions. Using the platform does not transfer to you any right over it beyond the use provided for in your plan. You may not copy it, resell access or try to extract the platform's source code.

Acceptable use

Do not use MadBuilder to:

• create or host illegal or fraudulent systems, or systems that violate third-party rights;
• process personal data without a legal basis;
• attack, overload or test the security of the platform without authorization;
• get around plan limits or AI quotas, for example by automating accounts to split one license;
• send spam or malicious code.

Artificial intelligence

The agent and the copilot use AI models. They work with your data and safety locks, but they can make mistakes. Review what the AI generates before deploying to production. Responsibility for the deployed system lies with whoever deploys it.

With your own key (BYOK), the terms and prices of the provider you chose apply, and billing is done by them. On the Mad Coding Plan, usage follows the quota of your tier.

MadCloud and copies

MadCloud hosts your system in the São Paulo region, with automatic backup and 30 days of retention. Even so, we recommend keeping your own copy of the project in Git or as a ZIP. You can move the system to your own server whenever you want.

Availability and liability

We work to keep the platform up and secure, but we do not guarantee uninterrupted operation, especially during the beta. We are not liable for losses caused by misuse, by third-party services (such as AI providers, Git or your server) or by decisions made based on what the AI generated.

Where the law allows limiting it, our total liability is limited to the amount you paid in the 12 months before the event. Nothing here removes rights that Brazil's Consumer Protection Code guarantees.

Suspension and termination

You can close your account at any time. We may suspend or close accounts that violate these terms, giving notice beforehand whenever possible. After termination, the data follows the rules of the privacy policy.

Changes, governing law and venue

When these terms change, the date at the top changes with them. Relevant changes are announced by email or on the platform before they take effect. Continuing to use MadBuilder after that means accepting the new version.

These terms are governed by the laws of Brazil. The courts of São Paulo/SP are chosen as the venue, without prejudice to the consumer's right to bring an action in their own place of residence.
